Residential Real Property Transfer Disclosure Statement Verbatim language required
AS 34.70.010 - 34.70.200; 12 AAC 64.930 (Form 08-4229)
Seller must deliver the completed state-mandated disclosure form to the buyer BEFORE the buyer makes a written offer; the form itself is prescribed by the Alaska Real Estate Commission by regulation.
Applies to: all residential 1-4 unit transfers (exemptions include first transfer of never-occupied new construction under AS 34.70.120, court-ordered transfers, and other statutory exemptions)
Waiver by Agreement
AS 34.70.110
Unlike most West Coast states, Alaska allows the disclosure statement to be waived entirely if seller and buyer agree in writing (state publishes a Waiver by Agreement form, May 2024 edition); waiver does not affect other disclosure obligations.
